Stephen O’Donnell
Stephen O’Donnell is a commercial lawyer with over 30 years of experience. He focuses on resolving business disputes through negotiation and settlement, mediation, arbitration or trial. Stephen has tried numerous cases to verdict in state and federal courts throughout the country, and in domestic and international arbitration venues.
Substantively, Stephen has developed a strong expertise in many forms of commercial insurance coverage negotiation and disputes, including professional liability, comprehensive general liability, employer professional liability, environmental impairment liability, first-party property, Bermuda form, and cyber liability coverage and placement disputes. In this context, he has litigated numerous allegations of bad faith claim handling, with a focus on California, New York and Illinois law. Stephen’s other areas of substantive expertise include reinsurance cases; “other insurance” contests between insurers; construction disputes, with a focus on pipeline construction disputes; construction insurance claims; securities disputes; limited liability company governance and dissolution disputes; fraud and misrepresentation cases; trade secret, unfair competition, and non-compete clause disputes, both in the employment contract and sale-of-business contexts; and debtor-creditor disputes, with a focus on disputes under statutes patterned on the Uniform Fraudulent Transfer Act.
