Tom Brusstar’s practice is concentrated in advising excess insurance interests in the management of general liability and professional liability matters, including every stage from policy wording concepts, to claims analysis, to coverage analysis and ultimately claims dispute resolution in courts and arbitration forums. He has managed mass tort exposures in the pharmaceutical, medical device, automotive, and agricultural chemical areas. He has managed expert testimony in many technical disciplines, including mechanical engineering, pharmaceutical safety, regulatory regimes, statistics, actuarial science, accounting, and underwriting. He has developed and defended complex specific-claim reserving programs in the mass tort context, and has conducted several London arbitrations construing Bermuda Form wordings. He has conducted coverage appeals in state and federal courts, including arguing before the Ninth Circuit Court of Appeals in 2022. Tom has led many continuing education presentations on liability and claims concepts, Bermuda Form analysis, and coverage for punitive damages. Tom is a Fellow of the American College of Coverage Counsel.
